The Inishowen Agreement, the Mandate and in defence of peaceful resolution

This article will detail events leading up to and including the peaceful agreement between anti water meter groups in the Inishowen peninsula, Donegal, Ireland and water meter subcontractor John Gildea, MBC Builders, Ballybofey, Donegal.

The article will also show how afterwards we were abandoned.  Elements have gathered on facebook and started an intimidation campaign against the brokers of the deal and in particular have singled out the elected spokesperson Mr Quigley.

In January of this year Buncrana Against Irish Water became aware of an exciting new development  concerning the Irish Water metering installation programme that had taken place in Moneymore, Drogheda, Co Louth.

We made contact with the central people in Moneymore, Gary and Anita Collins, and they agreed to come to a meeting in Buncrana to relate their story and explain how they finally achieved an agreement between the meter installing contractor and the residents of six housing estates ( six hundred houses ).

At the end of this riveting meeting ( 250 plus people ) those present indicated by an overwhelming  show of hands  that Buncrana Against Irish Water should attempt to replicate this type of agreement for the Inishowen peninsula.

With this mandate from the Inishowen people Buncrana Against Irish Water now set about formulating a strategy that would hopefully deliver a similar agreement
 

As can be seen in the link above, Buncrana Against Irish Water made extensive efforts by contacting An Garda Siochana, Irish Water, Meter Contractor and various politicians at local and national level. There are numerous correspondence including emails detailing all this effort.  In addition there were several committee meetings and local public meetings where our strategies were discussed.  All our efforts have been in public view on our facebook page 'Buncrana Together' and our web page www.buncranatogether.com.


Chronological Order of Correspondence Leading to Present Agreement


The following lists correspondences between Jack Murray, Sinn Fein and James Quigley  leading up to a meeting with John Gildea, MBC Builders, Ballybofey, meter installation sub contractor in Donegal.  


Out of the blue on 27/05/2015 James Quigley, chairperson of Buncrana Against Irish Water received an email from a Jack Murray, Sinn Fein.  This email stated;

On 28/05/15 a post was put up on IAWC facebook page by Sinead Stewart, admin about a discussion whether or not to accept an invitation to meet with the contractor MBC Builders. Buncrana Against Irish Water and other groups that were involved in the Sinn Fein's discussions were not consulted about this.  After approx 26 likes and 20 individual comments most of which were from people outside Inishowen the thread was finished. Most of the comments came protesters outside Inishowen mainly Letterkenny.  They were particularly strident comments and they demanded no meeting/contact with the contractor. IAWC very quickly caved in to the loud voices from Letterkenny, agreed they would not meet with the contractor and considered the topic was closed down.
Not only did IAWC go it alone without consulting other Inishowen groups but they did not take control of their own destiny for the Inishowen peninsula and weekly acquiesced to outsider demands. They  abandoned the the mandate given by the people at the Lake of Shadow's meeting, about which they were very much aware, considering a number of their influential members were present. This decision was quite shameful and demonstrated very poor judgement given the facts that existed.  They decided to abandon the road to a peaceful resolution to one of controversy and possible violence.


On 29/05/15, responding to a post in Buncrana Together querying  why IAWC decided to put it up on facebook,  Christina Crumlish, IAWC facebook admin said
“The intention of the post is stated within the post. Even though we in IAWC do not favour a meeting with the subcontractor, in our opinion this was not a decision which could be made by one or two small groups of people on behalf of the whole of Inishowen. This issue affects the whole of Inishowen. By putting it to the page we are obtaining as broad a range of views as possible and allowing those in Inishowen to decide for themselves. The majority of views we have obtained so far, both publicly and privately, have the opinion that it would be of no benefit to meet with the subcontractor. A view we share. We thank everyone for their input and trust this matter is now concluded.

On 02/06/15 Mr Quigley received this email from Sinn Fein

“Further to my previous correspondence regarding John Gildea's request for a meeting, his phone number is ***********.  I am asking that you would contact him directly as I do not wish to be a facilitator or mediator for John Gildea.The protesters may wish to nominate a spokesperson to contact him or each group may wish to contact him separately to discuss a possible meeting.”

After this last email there was no further communication from  Sinn Fein, local R2W or IAWC concerning a meeting with the contractor. 

 
On 03/06/15
Mr Quigley, chairman of Buncrana Against Irish Water, received a communication from Mr John Gildea looking for a meeting.  When questioned why he contacted Mr Quigley, he was told that the Sinn Fein gave him Mr Quigley's name.

Buncrana Against Irish Water, by way of contrast and after consultation with members of the or committee and other groups and individuals throughout Inishowen, decided to uphold the given mandate and initiate discussions with MBC Builders.  A delegation was agreed from across the peninsula and met with the contractor on 16th July.  The outcome was a huge success. A similar agreement to Moneymore  was hammered out after some tough negotiations. Mr Quigley was appointed spokesperson, shook hands with Mr Gildea on behalf of the delegation.  The delegation believed that they had achieved the objective as perthe Lake of Shadows mandate.
 

Orchestrated Orgy of Abuse, Threats, Misinformation

Now,unbelievably, comes a passage of posts on FB pages from Donegal Water Warriors and Inishowen Against Water Charges which would do justice to the Ku Klux Klan in terms of its vicious and obscene abuse directed mostly against Mr Quigley, spokesperson for the agreement negotiating team. Here's a selection.  We decided not to put names, however all this can be seen on the respective facebook pages.  (Links to various original pdf document are found at end of article)

“Thomas, may I ask you something, who in this community or for that matter James group had prior knowledge of his dealings with glides? I can assure you that this isn't the first time that meeting s have taken place without members knowledge or input. I could say more but hopefully at another time and place.”

Facebook bullying the mob attack

Perhaps its the well known feature of facebook bullying but this does not excuse people acting like a pack of hyenas picking out their prey and devouring it mindlessly. Both the IAWC and Donegal Water Warriors pages allow this type of hatred comments attacking anyone who dare voice opposition. It is difficult to accept that a small number of ignorant individuals mostly from outside Inishowen, none of whom attended the Lake of Shadows meeting, (posted on their FB page ) finds it acceptable to attempt to viciously bully people in the Inishowen peninsula  in an attempt at dictatorship. It is even more abhorrant and shameful that a small number of IAWC members joined in the ' feeding frenzy ' of abuse against a Buncrana resident.  

IAWC abandoned the people and the possibility of an agreement by not being capable of standing up to outside pressure. They have compounded their inexcusable actions by joining forces with the outsider aggressors. They have brought no honour either to themselves or their group by this low grade behaviour.

It must also be mentioned that the cowardly behaviour of Right2Water and other organisations including political parties have not gone amiss as they hunker down and witness this tsunami of abuse. Before going to print the first party to fully back the agreement and condemn the cyber bully was the IRSP. The non action of Right2Water both locally and nationally and that of the political parties is stark when it is remembered  how often we had to listen to the mantra of 'Unity'.


The only good to evolve out of this despicable, sorry episode is the existence of the agreement. All fair minded people must rally behind it and insist that divisive, base hatred and violent forces will not win the day. Outsiders who refuse to follow any path to a peaceful resolution should not be allowed to dictate to the residents of Inishowen.  Nasty confrontation and insult is the road to nowhere'

Inishowen Survey Will Be Undertaken By Anti Water Charge Groups

Elizabeth Arnett, Head of Communications for Irish Water stated on Newstalk today that she would investigate complaints from Buncrana Together.  A spokesperson for Buncrana Together, James Quigley, who put the questions to Ms Arnett stated that local groups will do a detailed survey of Inishowen areas which have already been metered.  This survey will then be presented to Irish Water.
 

On the Pat Kenny Newstalk radio show today Tuesday 30th 2015, Elizabeth Arnett, Irish Water's head of communications  responded to questions sent in by James Quigley, a member of Buncrana Together (see questions below). She confirmed that all residents should receive fourteen days notice prior to meter installation, followed by two days and finally a knock on the door informing the occupier the water about to be turned off and meter installed. She also confirmed that work should not be started before the recognised starting time.

On being informed by James Quigley that that was not happening in the Inishowen Peninsula Ms Arnett agreed to investigate the complaints that were supplied. See below supplied questions from Buncrana Together.

Although in the programme there were some very interesting questions and some interesting and questionable answers Elazabeth Arnett was let off the hook  by Pat Kenny.  In some instances not only did Pat not investigate topics but  many times he intervened and changed the subject, leading proceedings away from issues.  Below is an extract of Buncrana Together's questions and Ms Arnett's answers:

Question 1
BT:   "We have evidence of Irish Water sub contractors installing meters at unsocial times before their own stated commencing time of 7.30am.  People wake up in morning and find a meter installed. Is this not illegal."

Arnett"I wouldn't like to think we have contractors very early in the morning disturbing people.  So if that is the case, if people have been disturbed by construction noise very early in the morning we would encourage them to ring us and let us know and we would deal with that."

Bit of a fudge, don't you think?  Nothing about evidence, nothing about it being legal or not.  However, she does say if that is the case 'we would deal with that'.  Well Elizabeth, Irish Water have been informed on many occasions.  Irish Water will no doubt be informed again when the survey results will be forwarded to all relevant parties. 

Question 2
BT:  "In Inishowen Irish Water sub contractors have been installing meters
without any notice or warnings to householders. Irish Water have stated
on their site that householders will get 2 weeks notice with an
approximate starting date, then a 2 day notice prior to starting and
then Irish Water personnel will knock on doors to let people know they
are starting. Why is Irish Water not abiding by their own protocols?"

Arnett:  "Well we should not be doing that.  So if its not happening I'll look into it and make sure that it is.  Your are quite right people are entitled to get notice if we are going to be installing meters particularly when and if we have to limit the supply into the property, which is probable for about 15 minutes.  None the less people should be getting the notice and I will look into that."

Well that seems quite clear,  Notices have to be given.  However, Irish Water have  been supplied with information to the contrary by Buncrana Together and Moville Community Against Water Meters, many times and it has continued.  The organisers of the survey will be interested to know what Elizabeth and Irish Water will do when our complaints are substantiated.  For instance, what will they do about all the meters installed on properties who did not want them and did not get notified?

BT:   "Why does Irish Water not recognise No Meter Here signs on houses?
These houses had no contract with Irish Water?"

Arnett:   Well there isn't a question of contract.  When a change such as this is applied as a matter of law, then there isn't a question of contract.  That just doesn't come into it."

Pat Kenny, for some reason, interjected at this point and the two of them went on some  hypothetical ramblings, on a topic where neither he nor Ms Arnett were experts.  The question of Irish Water not respecting people's wishes, where householders clearly demonstrated this by a 'No Meter Sign'  and not having or wanting a contract with Irish Water is very relevant and one which is very much at the heart of the controversy on water charges.   For instance why is Irish Water so determined to get people to sign a contract with them?  Is this not a contract?  Why is it that Irish Water is forcing meters on people who do not want them?   Irish Water, since it's formation under the Water Services Act 2003, along with the Government have done every conceivable thing, including bribes, threats and questionable data collection, to make householders sign up with Irish Water.


Pat Kenny had a great opportunity to do the people of this county a favour and delve into some of the meatier questions which the Government and Irish Water have not answered.  Instead he demonstrated that his show is just entertainment, a make belief, giving the impression of impartiality.  This was very much demonstrated  by a question from Tim in Sandymount.  He had to ask twice about where Irish Water was getting their data on householders.  Even after the questioner ask for a second time saying that he felt his answer was not addressed, Elizabeth Arnett with the help of Pat Kenny was able to again sidestep the question, saying legislation, landlords, people phoning up and a variety of ways.. 

All in all, the interview is very interesting to listen to, especially to someone of a critical mind.   It is interesting to hear how Pat Kenny and Ms Arnett perform.   In between the subliminal messages of 'register', 'leaks', 'lead pipes' and '€100 euro grant',  there were some interesting morsels. Sometimes it's in the small print, or a word here and a phrase there.  Like Ms Arnett rubbishing Steven Donnelly, TD, figures in a question about whether the money Irish Water will recoup from customers will cover collection of that money.   Or  when Pat Kenny ask about how the meter detects leaks, is it volumetric or can it detect leaks down to the hour.  Ms Arnett said actually we can record data down to the hour and we can reset meters to do various things.  Isn't that interesting?  Various things!  

Arnett's Answers Not Acceptable

With the knowledge that approx 1000 meters have been illegally installed ( no notification, no notice of water being disconnected, vans with no logos, installing before 7.30am and abuse of residents ) from Muff, through Quigley's Pt through Redcastle through Moville through Greencastle and on to Gleneely, it is now past time that something was done about this state of affairs.

It is not acceptable to allow Irish Water to flout their own stated regulations and protocols and to allow them to ride roughshod over our residents and do nothing about it. They must not be allowed to abuse and threaten residents. We must bring them to book. We will hold Elizabeth Arnett to her word.

Survey Will Be Undertaken

On that basis Buncrana Together will now, with help other groups, carry out a detailed survey of the mentioned areas.

The results of this detailed survey will be presented to Irish Water, all elected representatives and An Garda Siochána. We will demand that the wrongs be rectified forthwith and to the residents satisfaction.

Elizabeth Arnett and Irish Water will be held to her promise of investigating the incidents. Irish Water have to be held to account for their actions. We have to ensure that the least they should do is to abide by their own regulations, treat the residents with respect, work within the law and deal swiftly with all abusive Irish Water personnel who have not done so.

Ard Na Gula Duibhe estate in Moville, Inishowen, Co Donegal completely metered by GMC Sierra Ltd installers on May 5th  without the resident's knowledge, without their consent and without being notified.  One 77 year old resident who did notice them at 6.45am was abused.  The installer shouted into her face "your poster is a joke and you are a joke".

Statement from Mrs Rose Boyle of 15 Ard Na Gula Duibhe, Moville

"My name is Mrs Rose Boyle of 15 Ard Na Gula Duibhe, Moville.  I am 77 years of age and  I suffer from diabetes.  On the morning of May 5th at 6.45am I noticed from my front room window an unmarked white van outside of my house and one man kneeling down at my water valve.  I went outside and approached the man and asked him several times what he was doing.  He ignored me and continued working.  Suddenly another man got out of the unmarked van and very quickly approached me.  he put his face right up against mine and shouted loudly "what's your problem?"  I said if he is installing a water meter I want him to stop and I pointed to the 'No Water Meter Here' poster clearly visible on my front room window.  He shouted into my face "You're poster is a joke and you are a joke."  I immediately felt very frightened and intimidated.  It took all the strength that I had left to go back inside my house where I have to admit I became very upset.  This should not have happened to me."

Statement from Ard Na Gula Duibhe Residents

Mr Eddie Farren spoke on behalf of residents "Mrs Bolye is one of the oldest and most respected residents of this estate.  This outrageous treatment of her by the Irish Water meter installers is unacceptable and will have to be investigated.  It has to be condemned by all right thinking people. 

No one in our estate knew that we had a meters installed even though we all had 'No Meter Posters' up on our windows.  We were not  notified by Irish Water.  One resident Patrick Mc Gilloway, no 1, had no water for 2 days until he investigated his stop valve and found that it had been switched off and had a meter installed.

We call on our public representatives to insist on an investigation as to how this was allowed to happen in the first instance.  Mrs Boyle  is due a personal apology from Irish Water, as indeed are rest of the residents of this estate who have had water meters installed without proper notification and without permission."

Rules And Agreement Broken by Irish Water Meter Installers

Enda Craig, Moville Anti Water Charges, said that every facet of this incident is synonymous with abuse.  This will be reported to all the relevant authorities especially irish water and An Garda Síochána.  We are calling for an immediate and independent investigation into this affair.  Irish Water must extend an unconditional personal apology to Mrs. Boyle.  Also we demand that all water meters illegally installed without proper notification, both here and in the rest of the Inishowen peninsula must be removed. 

Mr Craig said :

"1.  Irish Water agreed every resident would receive 2 weeks notice, then a 2 days notice and then the installers would knock on doors to advise residents of the imminent water meter installation.  None of that happened on this estate.

2.  Irish Water meter installers are permitted to work between 7.30am and 7.30pm.  In Mrs Boyle's case installers were working at 6.45am.  How long before that were they in Ard Na Gula Duibhe Estate?

3.  The first installer refused to acknowledge Mrs Boyle.  This is 'passive aggressive behaviour' and amounts to abuse.

4.  The second installer verbally shouted into Mrs Boyle face that 'she was a joke and her poster a joke'.  This resulted in her becoming very upset and frightened. She has still not got over this abuse.

5.  The installers showed no identification on their person or on their vehicle.  Against  Irish Water's stated protocol.

6  They failed to show any identity.

7.  They disconnected Mrs Boyle's water supply without any notice.

8.  They deliberately ignored 'No Meter Here' poster in Mrs Boyle's window and a verbal request to stop work.

9.  Mrs Boyle had not signed any contract with Irish Water..

 

Irish Water Can Not Be Believed

GMC Sierra Ltd which, owned by Denis O'Brien, is sub contracted by Irish Water to install meters in this Inishowen.  They started secretively installing meters here in mid April 2015.  They have not been adhering to Irish Water stated protocols in relation to installing meters.   See below Irish Water protocol.

Incidence of Abuse Not Being Investigated. Ignored by Local Politicians

To date these incidents have not been investigated.  Residents have not been contacted by either Irish Water or An Garda Síochána.  

All local politicians in the area have been notified and are well aware of what is going on.  Apart from Sinn Fein councillors, none have raised the slightest objection nor have they contacted residents.  In the case of 77 year old Mrs Rose Boyle she has been left on her own to deal with the aftermath of that gruesome ordeal.

In a later Inishowen Independent  article May28th Irish Water praised the professionalism of it's staff and told the newspaper  "Most of the metering teams are local workers and it is a testament to their professionalism and dedication that all incidents have been managed in an appropriate manner and that the overall targets for the metering programme continue to be met within the demanding quality standards."

Update :

 All metering in the Inishowen peninsula has been halted.  An Irish Water spokesperson said last week in the Inishowen Independent " there have been a number of instances of targeted aggression towards individual members of the metering teams in the Inishowen and Glenties areas of Donegal, which has necessitated the temporary cessation of works by the regional contractor, GMC Sierra, in these areas.  Individual incidents were reported to the Gardai and are being investigated."  However, local anti water charges campaigners flatly rejects Irish Water claims.
